Can a STEP-dad kick out my boyfriend even if the true mom wants him to stay?

My boyfriends step father is a total *** and favors his kid a million times over my boyfriend and even though ive only been with him for a few months, ive witnessed the favoritism...His stepfather already kicked out an older brother of his and is threatening to kick him out because he just turned 18... Can he legally kick him out even though he is not the father and the mother still wants him there????Can a STEP-dad kick out my boyfriend even if the true mom wants him to stay?
That totally depends on who owns the house. If the step father owns the house, or pays all the bills, then yes... he has every right to kick out your boyfriend (even if he's being a jerk about it).

Even if it's the mother's house, it isn't an issue of legality. It's possible the mother won't give up her marriage to keep her son in the house. I can't really say as far as the relationship goes. Can a STEP-dad kick out my boyfriend even if the true mom wants him to stay?
Is that the only reason for the dad to kick him out, because he is 18? Did your bf do something?

18 is a legal age to move out and be able to support oneself, but it sounds like to me that the stepdad feels some need to be the alpha male and is choosing who he wants in the pack. Since your bf and the older brother are both male, he feels inferior or something and is trying to get other males out of the house.

Also, if the stepdad the one paying for everything (the mortgage, the food, etc?) then he might legally be able to do so.

Your bf should talk to the mom and tell her that the stepdad is favoring his own child, and tell her that you are going to tell the stepdad ';this is between you and my mom';. And then its up to the mom to stand up for your bf.

If the mom cannot stand up for him, then it might be best for your bf to live with his dad. What a winner the mom chose to be her next husband!

Or your bf can cut a deal with the stepdad, say that he would like to concentrate on his studies. he will get a part time job to save up to be able to move and support himself since he cannot just leave right now without any money. After college graduation, he will start a full time job so he can fully support himself, but not before that. and then, stay out of the stepdads hair for the next four years!
he can do whatever he feels like it if the kid is an adult and he pays the bills. If the mom REALLY wanted her kids there she would have said something and they would be there, so apparently she doesnt care much.
it should be a joint decision between mom and step dad. I dont think its right to ';kick'; your child out reguardless of the situation or not. Good luck!!
Even though this is not your business, but i see that you really care and that's OK, but what kind of mother does he have to allow her ';new man'; who is not this person's father, to kick him out of the house even though the house my be owned by the step father and he pays all the bill, when he got with this woman he should have accepted her and her children or not accept either one of them. this is something your boyfriend has to deal with, with his MOTHER and STEP-father.
Ha!

YES ... if you don't like it, you and your BOY-friend should take care of yourselves ... oh', he can't.
I can't imagine being a mom and chosing a man over my child. I don't know if he can legally kick out your boyfriend without the mother's consent. It would probably depend on who owns the house, pay most of the bills, etc. Why doesn't the mother tell stepdad that her son stays? Is she worried that the stepdad will kick her out too? Tell your boyfriend to get a job and be prepared for the possibility of being kicked out. If his mom supports the stepdad in the decision(even if it is by merely doing or saying nothing) then your boyfriend will be out of the house. Once someone is 18 they are legally an adult, so he does have the possibility of being kicked out. Hopefully he will be able to make it on his own.
